SMART Communications, Inc. (“SMART”, “We”, or “Us”) respects your
fundamental right to privacy, and we commit to take great care in safeguarding your personal data.
In compliance with the Data Privacy Act, we share with you the principles that govern how your
personal data will be collected, processed, and shared as you participate in the TNT Anibersaya
Raffle Promo (the “Promo”).
Why we collect and process your personal data
Get a chance to win vouchers, phones, one year worth of data, and a brand-new Toyota Tamaraw when you
join the Promo and purchase or subscribe to eligible products and services.
To join, we will process your personal data, such as your mobile number and purchase history so that
we may:

Generate the corresponding digital raffle entries that you earn with your purchases or
subscriptions for the weekly and grand raffle draws. You may check the number of entries
that you have earned through TNT Anibersaya Raffle campaign page
(https://tntph.com/Pages/Anibersaya2025); and

Facilitate the claiming of the weekly and grand prizes:

If you win any of the physical prizes, such as mobile phones, cash prizes, one year
worth of data, or Toyota Tamaraw), an authorized Smart representative will call you
through your registered mobile number to validate your identity and ask for your
delivery address so that we can send you the formal notice via registered mail and
arrange the awarding of your prize.
Only the registered owners of the SIM are eligible to claim the prizes. When we validate your
identity, we may use the information you have provided to us when you registered your SIM.
We also intend to publish the list of winners on our TNT PH social media pages (TNT PH on Facebook
and @tntph on X. If you do not wish to be featured on our social media posts, or, if you have any
other concerns regarding this, please reach out to any of TNT’s official social media pages,

Why your personal data is shared
In case you win any of the physical prizes in the weekly and grand raffle draws, we are required to
share your Name and Address with the Department of Trade and Industry (“DTI”) in
compliance with The Consumer Act of the Philippines (Republic Act No. 7394). Your personal data will
be used by DTI to safeguard your consumer rights. As the executive department of the Philippine
Government that oversees the implementation of trade and consumer protection laws, the DTI is tasked
to oversee the handling of sales promotions such as this Promo.
We have engaged the services of Sterling Global Call Center Inc. (“Sterling Global”) to
contact the winners of physical prizes.
We will also share the names, delivery addresses, and contact numbers of raffle winners with Wide
Wide World Express Corporation (“WExpress”) and Speedex Courier and Forwarder, Inc. (“Speedex”)
for the delivery of formal notices and device prizes.
If you win the cash prize, we will disclose relevant information with Union Bank of the Philippines (“UnionBank”)
to facilitate the claiming of the check issued in your name. Note that the encashment of the check
will follow the standard process of the bank.
If you win the grand prize, we will also disclose relevant personal data about you with Toyota Motor
Philippines to arrange the claiming of the vehicle.
When your personal data is shared, we ensure that it is done on a confidential basis, through secure
channels, and in compliance with applicable privacy laws and regulations. Only personnel with a
need-to-know will have access to your personal data.
How your personal data is protected
The integrity, confidentiality, and security of your personal data is important to us. This is why we
strictly enforce this Privacy Notice within SMART and have implemented technical, organizational,
and physical security measures that are designed to protect your information from unauthorized or
fraudulent access, alteration, disclosure, misuse, and other unlawful activities. Your personal data
is also protected from other natural and human dangers.
Personal data relating to your participation in the Promo will be retained only until after the last
announcement of winners on August 9, 2025. In case you win, we will retain your information for up
to 60 days from the announcement of winners in compliance with DTI regulations.
Your Rights and Choices
The Data Privacy Act gives you certain rights to your personal data. Subject to exceptions under the
law, you are entitled to request:

Access to the personal data we process about you;

Rectification of your personal data if it is found to be outdated, inaccurate, or
incomplete;

Erasure when it is no longer needed to achieve the legitimate purpose of its processing;

Restriction of processing of your personal data in limited circumstances;

Portability of your personal data so that you may receive a copy thereof or that we transmit
the same to another company on your behalf.
You moreover have a right to object to the processing of your personal data, such as in cases when we
process your personal data based on our legitimate interests or for purposes requiring your
consent.
To the extent that the processing of your personal data is based on your consent, you have the right
to withdraw such consent at any time by contacting our Data Privacy Officer through the contact
details provided below. Please note that this will not affect the lawfulness of the processing that
was carried out before you withdrew your consent or SMART’s right to continue parts of the
processing based on other legal bases than your consent. If, however, we have not provided you with
another legal basis justifying the processing of your personal data in this privacy statement, we
will stop the processing and delete your personal data.
To exercise any of these rights, you may get in touch with our Data Privacy Officer through the
contact details indicated below. In some instances, we may request supporting documents or proof
before we effect any requested changes to your personal data.
If, despite our commitment and efforts to protect your personal data, you believe that your data
privacy rights have been violated, we encourage you to come to SMART first so that we can work
together to resolve your complaint. You have the right at all times to register a complaint directly
with the National Privacy Commission (“NPC”) or to make a claim against us with a
competent court (either in the country where you live, the country where you work or the country
where you deem that data privacy law has been infringed).
