that govern how your personal data will be collected, processed, and shared as you participate
in the TNT Paskong Panalo (the “Promo”).
Why we collect and process your personal data
Get a chance to win gadgets, group quality time with TNT’s endorsers, and cash of up to one
million pesos when you purchase or subscribe to eligible products and services and join the
promo.
To join, we will process your personal data, such as your mobile number, usage information,
and regional location so that we may:

Generate the corresponding digital raffle entries that you earn with your purchases or
subscriptions for the weekly raffle draws. For the main raffle draw, you may check the

Facilitate the claiming of the weekly prizes. If you win any of the cash or physical
prizes
(for example, a mobile phone in the weekly raffle draws), an authorized Smart
representative will
call you through your registered mobile number to validate your identity and ask for
your delivery
address so that we can send you the formal notice via registered mail and arrange the
claiming of your prize.

If you win a group quality time with TNT’s endorsers, an authorized Smart
representative
will call you
through your registered mobile number to validate your identity and ask for your
delivery address so that we
can send you the formal notice via registered mail. Should you need to travel via air or
sea to be able to attend
the event, we may request for additional information from you for us to arrange your
transportation.
Only the registered owners of the SIM are eligible to claim the prizes. When we validate your
identity, we may use the
information you have provided to us when you applied for your postpaid plan or when you
registered your SIM.
We also intend to publish the list of Promo winners on our TNT social media pages on Facebook,
Instagram, X, TikTok,
and YouTube. If you do not wish to be featured on our social media posts, or, if you have any
other concerns regarding

Why your personal data is shared
In case you win any of the prizes in the raffle draw, we will also share the name, mobile number,
and address with the
Department of Trade and Industry (“DTI”) in compliance with The Consumer Act of the
Philippines
(Republic Act No. 7394).
Your Personal Data will be used by DTI to safeguard your consumer rights. As the executive
department of the Philippine Government
that oversees the implementation of trade and consumer protection laws, the DTI is tasked to
oversee the handling of sales
promotions such as this Promo.
We have engaged the services of Sterling Global Call Center Inc. (“Sterling Global”)
to contact
the winners of physical prizes and inform them on how to claim their prizes.
When your Personal Data is shared, we ensure that it is done on a confidential basis, through
secure channels, and in compliance with applicable privacy laws and regulations. Only personnel
with a need-to-know will have access to your Personal Data.
How your personal data is protected
The integrity, confidentiality, and security of your personal data is important to us. This is
why we strictly enforce this Privacy Notice within SMART and have implemented technical,
organizational, and physical security measures that are designed to protect your information
from unauthorized or fraudulent access, alteration, disclosure, misuse, and other unlawful
activities. Your personal data is also protected from other natural and human dangers.
Personal data relating to your participation in the Promo will be retained only until after the
last announcement of winners on January 11, 2025.
Your Rights and Choices
The Data Privacy Act gives you certain rights to your personal data. Subject to exceptions under
the law, you are entitled to request:

through the contact details provided below. Please note that this will not affect the lawfulness
of the processing that was carried out before you withdrew your consent or SMART’s right
to
continue parts of the processing based on other legal bases than your consent. If, however, we
have not provided you with another legal basis justifying the processing of your personal data
in this privacy statement, we will stop the processing and delete your personal data.

before we effect any requested changes to your personal data.
If, despite our commitment and efforts to protect your personal data, you believe that your data
privacy rights have been violated, we encourage you to come to SMART first so that we can work
together to resolve your complaint. You have the right at all times to register a complaint
directly with the National Privacy Commission or to make a claim against us with a competent
court (either in the country where you live, the country where you work or the country where you
deem that data privacy law has been infringed).
